By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services or make a purchase. By using the Services, you represent that you meet this requirement.

2. Account Registration

Prices are listed in U.S. Dollars (USD) and may change without notice. The price displayed at checkout is the final price.
We make every effort to display product images and descriptions accurately, but actual products may vary slightly due to lighting, screen settings, and manufacturing tolerances.

4. Orders & Payment

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline orders for any reason, including suspected fraud, pricing errors, or unavailable inventory.
Accepted payment methods include major credit cards (Visa, Mastercard, American Express, Discover), PayPal, Shop Pay, Apple Pay, Google Pay, and other methods displayed at checkout.
Your card or payment method will be charged at the time of order confirmation.
Sales tax is calculated based on your shipping address and applicable state and local laws.

7. Promotional Codes & Discounts

Promotional codes are subject to specific terms and may not be combined with other offers unless specified.

Promotional codes have no cash value and are not transferable.
Bulk orders, resale orders, or orders that appear abusive may be cancelled at our discretion.

8. Intellectual Property

All content on the Services — including logos, designs, text, images, videos, and product photos — is the property of INSMIA / SHOESHACK INC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not:

Scrape, crawl, or index the Services without permission

9. User Conduct

When using the Services, you agree NOT to:

We reserve the right to terminate accounts and refer violations to law enforcement.

10. User-Generated Content

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the Services will be uninterrupted, error-free, or secure.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSMIA / SHOESHACK INC AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, consequential, special, or punitive damages
Loss of profits, data, goodwill, or business opportunity
Damages arising from your use of or inability to use the Services
Damages caused by third parties

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID FOR THE PRODUCTS GIVING RISE TO THE CLAIM, OR
ONE HUNDRED U.S. DOLLARS ($100)

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless INSMIA / SHOESHACK INC and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

Your violation of these Terms
Your misuse of the Services
Your infringement of third-party rights

15. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

16. Dispute Resolution & Arbitration

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in Spokane, Washington (or, at your election, your home state)
Each party bears its own costs unless the arbitrator awards otherwise
The arbitrator's decision is final and binding

Class Action Waiver: You and INSMIA agree to bring claims only in your individual capacity and not as part of any class or representative action.

Exception: Either party may bring an action in small claims court for qualifying disputes.

Opt-Out: You may opt out of arbitration by sending written notice to support@insmia.com within 30 days of first accepting these Terms.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Material changes will be communicated via email or website notice. Continued use of the Services after changes constitutes acceptance.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and INSMIA regarding the Services.
